Resolving issues

All seemed good at first, but once a problem arose, things deteriorated between myself and Mr Manuel. I purchased a 2007 Shogun [R8 DEH] from here in May this year, and the issue has only been resolved this week with me being able to get shot of the vehicle. Wasted the summer being tied up dealing with this though. Glenn Manuel doesn't believe in, or recognise your consumer rights under the consumer rights act 2015, and refused to take the vehicle he sold me back for a full refund despite the air con not working. The air con working was an agreed condition of sale, as well as rusty rear wheel arches being sorted, which they were. He had more than one opportunity to fix this problem, but it still wasn't working when I got shot of the vehicle this week. Therefore if you do have to get a vehicle from here, make sure you use your credit card for at least £100 of the purchase price. This will give you consumer protection, and a way to get a refund when Glenn refuses, even if you are within your rights to request a full refund and return of the vehicle. You could be left with a vehicle you'll have to dispose of yourself, but at least you shouldn't be too much out of pocket. I've been left a few hundred quid down, but without section 75 protection, it could have been a few thousand. You'd be doing yourself a favour if you look into the history of Baytree car sales before getting involved with them in the first place. I found some interesting stuff relating to them on the Internet. It's out there in the public domain, so there's no danger defamation action. Personally, I'd advise avoiding this outfit altogether. I've noticed that Glenn is quick to get defensive, and threaten legal action against people who have left negative reviews, which is fair enough when reviews are dishonest, but as I have only put down the facts as I have experienced them, that isn't a problem here. Hopefully Glenn will learn something from the issues I've mentioned, and realise that buyers do have the right to request a refund under certain circumstances. He often states that he has no record of negative reviewers having purchased a vehicle from him, so I'm interested in what the response to this review will be. Caveat Emptor as the saying goes!

Glenn from Baytree Car Sales in response to Good start, but didn't last!

Mr paine just to clear this right up ,you purchased the car back in May and was told that the rear arches needed to be touch in due to surface bubbling which is pretty normal from a 15 year old shogun. Also air con was not as cold as your 19 plate mokka which it wouldn't be .but you wouldn't have it You then got the car re moted a 4 weeks later and had issue with 2 track rod ends. and then used a different mot station again 4 weeks after for some bizarre reason . Nothing we did for you was good enough as your the sort of guy who knows it all .so I leave you with this Mr paine. If any consumer rights acts was broken which they wasn't in any way under any section .you would have been entitled to a refund be it paid by any means but they wasn't. Just feels like you bought a old shogun and was trying to compare it to a new car you use and there worlds apart . Also as for this information that's widely out there for a garage that's been here 30 years of trading there will be plenty 👍 But out of the hundreds of cars sold yearly The reputation speaks for it self .more positive reviews than negatives in regards to the way the garage is. unfortunately you can't please everyone but we try are best So I will leave you with your maladriot ways All the best 👍

M. Paine in response to Good start, but didn't last!

This response is to the Bay response to my initial review. To Glenn of Baytree car sales. When I viewed the Shogun, you told me the a/c system just needed re-gassing. You agreed to ensure it was working when I collected the vehicle. You also agreed to sort out the rusty rear wheel arches, which I mentioned you had done, so when you bring that up, you seem to be defending yourself against yourself! The a/c on this, or any vehicle, either works or doesn't work. At the viewing, you never mentioned anything about the a/c not being cold due to the age of the vehicle. If you had, it would have saved us all a lot of time and hassle, even more so if you'd mentioned it on the phone when I made enquiries about the Shogun. However, the laws of physics do not change with age. I recently owned a 2006 Jeep that had excellent a/c, and I've owned much older vehicles with good a/c systems, so that argument doesn't stand up. You also mentioned a 19 plate Mokka. We do not have a 19 plate Mokka! Ours is a 64 plate, 2014 Mokka! After the last time time you had the Shogun in your establishment, you told me the tracking had been done, and the a/c had been re-gassed, then checked for leaks. The fact that it needed re-gassing so soon after the previous time should have been a heads up to a problem that was clearly missed or overlooked [ignored]. I'd informed you if the vehicle was not right, then I would want to return it for a full refund. On driving home in the Shogun after this period with you, it soon became clear that there was no change in the feel of the vehicle handling, when there should have been if the tracking had indeed been checked and adjusted. The a/c was still not blowing cool air, never mind cold air, so what is your excuse for this? When I got home, I told you that I wanted a refund and to return the vehicle. You told me that you don't take vehicles back due to the a/c not working, despite the fact that I was within my rights to request this as the vehicle was not in the condition as agreed on at point of sale. We did agree to the a/c working and the rusty arches being sorted, did we not? You sorted the wheel arches, but the a/c was still not working as it should. You can't argue or dispute that fact. I expect you will try to though, because you seem incapable of admitting to your mistakes. In fact, it was your reluctance to entertain the idea of refunding me and taking the vehicle back that made me suspicious of the vehicle and your outfit and led to me deciding to get it mot'd again. Needless to say, I was informed that the tracking was out, and it went on to fail the mot on worn track rod ends! The mot inspector also mentioned that he had spotted two a/c pipes that at some point in the past had been cut, and the open ends squeezed shut. There had been no mention of these cut pipes from you even though the system had apparently been checked for leaks. I never did get an explanation for this from you. I replaced the track rod ends at my own expense as I deemed it to be fair enough because it was my decision to mot the vehicle. However, when I took it for the next mot, it failed again. Excessive corrosion and some other worn bushes and ball joints was the reason this time. Different tester sees different things. Humans! This mot was carried out at the same establishment as the previous mot test, yet you say it was at a completely different garage, for some bizarre reason, so it makes me wonder if you actually read or understand any of the documentation I sent you. We were obviously not going to agree on these issues, so I started to get my paperwork together in preparation for court action. I also went to the bank to submit a section 75 claim. Luckily, for Glenn, the section 75 claim refunded me, so court action was avoided. After all, this is not a discussion, just a statement of facts. I'm sure Glenn will continue to dispute these facts and go on about how many cars he sells, all the good reviews and experiences his customers have, etc, but this is not about them. It's not that I am difficult to please, but I am easily displeased when people fail to deliver what they say they will. This was not the first vehicle purchase I've experienced, but it is the worst vehicle purchase I've experienced By the way, I don't know it all, but as a mechanical engineering technician, and having worked on agricultural machinery, motorcycles, cars, including a spell at Lotus Cars in Hethel, and many years in aviation, I do know something. My mistake here was to trust you [Glenn] to do the right thing. I had mentioned to you that I'd been let down by other dealers earlier in the year and was fed up because I am often not physically up to crawling around under vehicles these days. If I had done, I would have walked away and all this would have been avoided. However, you said all the right things to make us feel we could trust you to do the right thing. From now on, due to my trust in motor traders being shattered by this experience, I will force myself to crawl around to check any vehicle I view no matter what it does to my body. It'll still be less stressful than this experience has been. Also, I am familiar with the word Maladroit, but what does Maladriot mean? Yours, M. P.

Unfortunately I was stung buying a car from these people. I chased more than 10 times for the service history on the car still to no avail. The gearbox is faulty resulting in not being able to drive the car. Clocked mileage that the garage take no responsibility for. I was due to take the company to small claims but due to my location, it made the cost enormous so now I am left to foot the bill of a gearbox repair amounting to roughly £1350!! I must add, I replaced a few parts on the car at my own cost as they were only minor bits IE ARB droplinks, new battery and ARB bushes. Buyers beware.

Glenn from Baytree Car Sales in response to Do NOT buy from here

So this is a very interesting review . this car was a golf r32 a Japanese import (not imported by us) You purchased the car and had it shipped to the Isle of man You did get all of the service history which was in Japanese plus the service work we had carried out on the car . You also was so happy with the car sending me watts app videos of you driving very fast with racing numbers on the car which we have videos off . Then decided to tell me the clutch had issues as well as drop links and bushes . My reply was simply I'm not gonna warrent a car that's used like its been stolen or doing Laps of the nurburg ring as its not classed as general wear and tear .it's a road car not a race car . And the RAC have said the same in regards to the repair

M. Paine in response to Do NOT buy from here

Personally, I feel Glenn should stick to high end cars as he clearly doesn't care about us lower profit minions who can only afford older, more troublesome vehicles.

M. Paine in response to Do NOT buy from here

I have to agree with the response Glenn posted to this one. If you're going to use it for racing, you can't expect someone else to pick up the pieces.

Mark in response to Do NOT buy from here

Just to note. The car wasn’t used for racing. The “racing numbers” was my photography business logo on the side of the car. I had battery issues from day one and sent a video of me doing roughly 70-80mph (derestricted mountain road so well with legal limits) to show the car was now running okay. Gearbox issue was from day one including a number of warning lights on dash. I am also still yet to receive copies of UK service history. As Mr Paine highlighted, Baytree cars don’t respect Consumer Rights Act.

M. Paine in response to Do NOT buy from here

While it's probably a positive experience for most buyers here, to dismiss and deny anything negative occurring is simply unrealistic. Everyone gets it wrong occasionally. Glenn needs to accept that, man up, and hold his hands up to his errors, not just slag off disgruntled customers and try to pass the buck, or attempt to avoid responsibility. I know there are some people out there who will be awkward or try it on, but most people will have genuine issues that should be addressed properly. Nobody wants aggro when you're in need of transport. My own experience with Baytree car sales was the first time I've had a really negative outcome, and I'm nearly 60yrs old and been around, so I know it's not me! _ _ ○|○ ~

Mark in response to Do NOT buy from here

Completely agree. I think location for myself got the better of me as I couldn’t simply ‘turn up’ to this outfit. Also myself paying debit card has majorly stung me with now having a car sitting on the driveway since as I can’t afford the repairs. He says the RAC dismissed the repairs however I have the emails confirming the repair could go ahead (at a max value of £500) and complete failure of the clutch system was a month into owning the car. I am now rocking around in a £500 renault clio with a clutch that has seen better days (it is 20 years old) yet is still out performing my Golf. Mr Paine, it’s not just you and i’m glad you got sorted. Unfortunately I am left paying a monthly fee for a car I can’t drive.

M. Paine in response to Do NOT buy from here

Mark W. There is a thing called chargeback that might get you refunded on a debit card. Ask your bank about it.

Bought car , it was supposed to have a new clutch put in it . We didn’t think it had been done so took to local garage who confirmed it had no new clutch . We gave them the opportunity to correct this , which they did . 1 week later the engine management light came on and car went into limp mode . They kept it for a week , gave it back “ fixed” I drove 8 miles and the same thing happened . They had it back for another week , bought it back fixed, I turned it on the same day and engine management light came on . I phoned Glenn and said I would like my money back . He spent 10 minutes telling me how wonderful he had been and all he had done etc etc then said well the car is nearly out of warranty . I said “ nearly isn’t the same as out of warranty “ He then said he had paperwork in Fri t of him saying I agreed to a 1 month warranty, I had my sales invoice in front of me saying 3 months . He must suffer from delusions obviously poor man . He said if I wanted a refund then to take him to court . I was happy to do this but my husband said get it fixed then get rid of it . So they had it again for 2 weeks , after dropping me off a courtesy car so caked in bird muck I refused to drive it , they gave it back fixed and suprise suprise first time I started it up engine management light came on . I have now sold it , loosing £1500 in the meantime .

I really don’t enjoy giving a local business such a poor review but just feel so frustrated at Bay Tree Car Sales lack of care post sale. The car arrived with rotten front tyres and the car vibrated when driving. There was no spare tyre and they said they would send a repair kit in the post. They didn’t and quite frankly couldn’t care less. Shocking after sales care
