"Dear oh dear... Where do I start?"

Resolving issues

Dear oh dear. Where to start? 2 February 2023 to 9 August 2023, 6 of the most stressful months of our lives. Nearly £2,500 out of pocket and we no longer own Volvo XC90 - WJ62 JUY I will try to keep this as short as possible (I could honestly write a short book) but – I want you to read this. Please read! After more than SIX months of ownership, we were only in possession of the car for FOUR months. We had no choice but to sell the car back to LM Select for just under £2,500 less than we paid for it. So, here’s the story of “Six months (or four actually) - with WJ62 JUY” So, we were looking for a good used Volvo XC90 in silver for a number of months when we saw one with 59,000 miles on the clock and being advertised by LM SELECT LTD in Chesterfield for £15,990. On the 2nd February 2023, we picked up WJ62 JUY (a ‘Thalia Silver’ 2012 Volvo XC90 D5 EXECUTIVE AWD 200BHP). Strangely, the mileage at the last MOT (15 November 2022) was recorded as 60,049 miles (as can be seen for MOT Test Number 4569 5032 1290 via www.check-mot.service.gov.uk) – however, the mileage was 59,000 as advertised and when we bought the car. Not quite sure what happened there? We test drove the vehicle and it seemed okay, no surprises, we’d had our 145,000 miler one for 5 years and knew these cars inside out. Leon sold us the vehicle and away we went! Sadly, we'd soon be back! Within a month of ownership, the following faults became apparent: (1) Constant vibration/rattling inside the driver door. (2) Passenger window goes straight back down when closing. (3) Brakes squealing badly (happened as soon as we had picked up/driving home). (4) Bits of trim began to lift (I have a photo of the window trim lifting) – as if it had been poorly glued down (5) The electronic side panel (driver seat control) snapped in half, again, as if it had been poorly glued together by someone as it had previously broken. I could see the old/dried glue, on the inside of the now snapped in half electronic side panel. (6) I noticed one of the “Executive” badges was missing from one of the rear passenger window pillars. This was either not there when we bought the car (and we may not have noticed) or it had fallen off shortly after we’d purchased it. I sent Leon a new/replacement one (£40 and only found in Eastern Europe!) - when the car was returned to him. I hope the new owner thinks it looks smarter. Also, they got the boot liner I bought - that was another £70. Monday 17th April 2023. The keys failed to start vehicle and LM Select were advised of this in a series of emails I have records of. Numerous video evidence/loaded to You Tube (private videos). Message “Start Prevented”. Links to my recorded video clip as follows: (91) April 2023 XC90 fault 1 - YouTube (91) xc90 April fault clip 2 - YouTube The vehicle was collected by LM Select. LM Select were in possession of the vehicle for a total of 12 days. Saturday 29th April 2023. We had to make a 2hr round journey to collect the car in person from Vicki at LM Select’s premises. Vicki, by the way, is a lovely lady. Saturday 3 June 2023. The vehicle broke down again on the evening of Saturday 3rd June 2023 and was recovered by our breakdown provider. Complete power loss, no brakes or steering available. Fortunately, this happened within a supermarket car park or could have been catastrophic/life threatening results to vehicle occupants or pedestrians/people packing shopping in their car. Links to my recorded video clip as follows: https://youtube.com/shorts/d7tLz-Y3rpU?feature=share Monday 5th June 2023. The vehicle was recovered from our home address (by ‘Start Rescue’ recovery truck) and transported over 40 miles to a garage in Chesterfield as instructed by LM Select). On Wednesday 7th June, I sent a letter attached to an email to LM Select after seeking advice from “Which?” Consumer Rights Group (of which I am a member). No written response was received. I have a copy of that letter (and email). On Thursday 8th June, I sent LM Select an email titled: “Further advice received regarding refund - Volvo XC90 - reg. WJ62 JUY.” No written response was received. I have a copy of that email. LM Select were in possession of the vehicle for a further 24 days. Thursday 29th June 2023. The vehicle was returned to our home address. The keys were left with my wife as I was in an online meeting (work from home). I went out to the vehicle 45 minutes later. The vehicle failed to start with one of the keys - FFS - NOT AGAIN! Links to my recorded video clip as follows: (91) Volvo XC90 recurring problem car returned today just tried to start it, same problem as in April. - YouTube I am a member of “Which?” consumer rights group and I had to spend a long time waiting to get through and then a length telephone conversation with them to confirm our consumer rights under the Consumer Rights Act 2015. I had to spend a lot of my time reading information from The Motor Ombudsman’s website: What can I do about a used car problem? - The Motor Ombudsman LM Select Ltd. had more than one opportunity to fix the problem. The fault/message being shown on the THIRD breakdown was the same message that was displayed in March and April 2023. The fault was not satisfactorily rectified following a fair and reasonable amount of time for LM Select to repair the fault. As of Monday 3 July 2023, the vehicle remained with LM Select Ltd. in Chesterfield. At no point in this one month (in total) without the vehicle, were we offered a replacement vehicle or a courtesy car. We were without a full-sized family vehicle for a combined total of one month between February and July 2023 (we have two children and elderly parents who require lifts to medical appointments!) - so STRESSFUL! On the 9 August 2023, we received a partial (and final) refund of £13,500 back from LM Select. Make of that what you will. We had asked for £15,000 (i.e. a loss of £800 or £200 a month would have been more than enough on a 10 year old car, there is no way we should have lost nearly £2,500 after just 4 months of use! Leon, like any used car “dealer”, will have made a healthy profit when he sold us the car the first time around. That’s capitalism/business. No problem with that. What I do have a problem with is the stress that LM SELECT LTD. caused to both me and my wife. We are the ones who have lost out here. I am pretty sure he will be making another profit when he moves the car on again at some point in the future, which seems unreasonable and unfair? The experience was upsetting, stressful and wholly disappointing. We purchased an expensive vehicle from a reputable dealer and not a private purchase/sale, for the very objective/reason of avoiding this from happening. Leon is the sort of guy we really wanted to like and trust. We have been left feeling we are no longer able to do that. Sadly, we are not able to recommend LM SELECT LTD.
